Terms of Service

Welcome to Home Tulbox (the "Site," "Platform," "we," "us," or "our"), operated by C2Multimedia, publisher of Resource Living Magazines. These Terms of Service ("Terms") govern your access to and use of hometulbox.com, our mobile applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Home Tulbox is an online marketplace that connects homeowners ("Homeowners") seeking home services with independent home service professionals and contractors ("Pros") who offer such services. Home Tulbox allows Homeowners to search for Pros, submit job requests, view provider profiles and reviews, and access coupons and promotions. Home Tulbox allows Pros to create profiles, list services, and connect with prospective customers.

Home Tulbox is not a party to any agreement between a Homeowner and a Pro. We do not employ, supervise, or control any Pro, and we do not perform, guarantee, warrant, or insure any home service work. Any contract for services is solely between the Homeowner and the Pro.

2. Eligibility and Accounts

  • You must be at least 18 years old and capable of forming a binding contract to use the Service.
  • You agree to provide accurate, current, and complete information when creating an account and to keep that information up to date.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms or that we believe, in our sole discretion, pose a risk to the Service or other users.

3. Homeowner Terms

  • Submitting a job request does not guarantee that any Pro will respond, and does not create an obligation to hire any particular Pro.
  • Home Tulbox does not verify, in all cases, the licensing, insurance, background, or qualifications of every Pro listed on the Platform. Homeowners are responsible for conducting their own due diligence — including verifying licenses, insurance, and references — before hiring any Pro.
  • Any pricing, quotes, scheduling, deposits, or payment terms are negotiated directly between the Homeowner and the Pro, unless otherwise expressly stated on the Platform.

4. Pro (Professional) Terms

  • Pros represent and warrant that they hold all licenses, permits, certifications, and insurance required by applicable law to perform the services they list.
  • Pros are independent contractors and are not employees, agents, partners, or joint venturers of Home Tulbox.
  • Pros are solely responsible for the quality, safety, legality, and performance of the services they provide, and for complying with all applicable laws, including consumer protection and licensing laws.
  • Home Tulbox may charge fees for premium listings, advertising placements, or subscription plans, as described on our Pricing page. Fees are non-refundable except as required by law or as otherwise stated at the time of purchase.

5. Reviews and User Content

  • Users may submit reviews, ratings, photos, job postings, and other content ("User Content"). You retain ownership of your User Content but grant Home Tulbox a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute it in connection with operating and promoting the Service.
  • Reviews must reflect genuine experiences. You may not post false, defamatory, misleading, or fraudulent content, and you may not post content on behalf of a business you own or are affiliated with as though it were an independent customer review.
  • We reserve the right, but have no obligation, to monitor, edit, or remove User Content that violates these Terms or that we find objectionable for any reason.

6. Coupons and Promotions

Coupons, discounts, and promotional offers displayed on the Platform are provided by participating Pros or third parties and are subject to the terms, restrictions, and expiration dates stated with each offer. Home Tulbox is not responsible for a Pro's failure to honor a coupon or promotion.

7. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity;
  • Circumvent, disable, or interfere with the security or proper functioning of the Service;
  • Scrape, harvest, or collect data from the Platform using automated means without our prior written consent;
  • Post false, defamatory, or fraudulent job requests, reviews, or provider information;
  • Use contact information obtained through the Platform for unsolicited marketing or spam.

8. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by Home Tulbox. We are not responsible for the content, policies, or practices of any third-party sites.

9. Disclaimers

THE SERVICE AND ALL CONTENT, PROVIDER LISTINGS, AND MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. HOME TULBOX DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PRO'S WORK WILL MEET YOUR EXPECTATIONS OR APPLICABLE STANDARDS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOME TULBOX, C2MULTIMEDIA, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR ANY SERVICES PERFORMED BY A PRO. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO HOME TULBOX IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless Home Tulbox and C2Multimedia from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or any dispute between a Homeowner and a Pro.

12. Dispute Resolution

Home Tulbox is not responsible for resolving disputes between Homeowners and Pros, though we may, at our discretion, assist in facilitating communication. Any dispute regarding these Terms shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles. [Optional: insert arbitration clause and venue if desired.]

13. Modifications to the Service and Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; material changes will be indicated by updating the "Last Updated" date above, and continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law provisions.
